Competition Terms and Conditions
- General
- These terms and conditions
are the Competition Rules (Rules) and apply to The 2010 Musical Comedy
Awards Competition (Competition) on www.musicalcomedy.co.uk
(Our Site). By entering the Competition, entrants agree
to be bound by these Rules.
- All entrants have read, are
aware of and agree to be bound by the Terms of Use of Our Site. In the event of any conflict between
the Rules and the Terms of Use, the Terms of Use shall have priority.
- The Competition is organised
by Avin A Larf Limited. We are registered in England and Wales under
company number 06569873 and have Our registered office at 1 Broomfield Road,
Coventry, West Midlands, CV5
6JW. (Us and We).
- We reserve the right to cancel
or amend the Competition or the Rules without notice in the event of
a catastrophe, war, civil or military disturbance, act of God or any
actual or anticipated breach of any applicable law or regulation or
any other event outside our reasonable control. Any changes will be
posted within these Rules or on Our Site.
- In the event of any dispute
regarding the Rules, conduct, results and all other matters relating
to a Competition, Our decision shall be final and no correspondence
or discussion shall be entered into.
- Important Competition
Information
- The venue and time for the Competition final (Final)
will be the New Players Theatre on March 26th 2010 at 8pm
- You cannot enter the Awards if you have performed as a headline act to over 400 people or had your own TV or Radio show broadcast.
- In entering the Competition
you agree and undertake that you will be available to attend and perform
a live heat at the Wilmington Arms, London. You will be allocated a slot on either Jan 9th, 16th, 23rd or 30th between 1.30 and 4pm. Due to the number of contestants taking part and the need for consistency, we will only be able to reallocate slots in rare circumstances. If you are entering the Awards, please be aware that successful entrants will be required to perform in January and potentially on two Saturdays in February. Should you not be in a position to attend the heats,
your Competition Entry will not be valid.
- The format of the Competition
is as follows:
- Entrants will upload their
original musical comedy video (Competition Entry) onto Our Site
between September 1st 2009 and midnight on 12th
December 2009, in accordance with the Terms of Use;
- Judges Tim Arthur, Earl Okin and Leisa Rea will select their favourite forty entries to perform in the live heats.
- The first round and Quarter-finals of the live heats will involve ten acts performing five minutes of their material each and will be judged by a combination of audience and judge votes. From each live heat of ten artists, five will progress to the next round. In the semi-final, each of the ten acts will perform a 8-10 minute set.
- The dates for the heats are as follows. First round: January 9, 16, 23, 30. Quarter-Finals: February 13, 27. Semi-Final: March 6. All heats will take place at the Wilmington Arms, London between 1.30 and 4pm.
- The five finalists will perform in the final (dates and venue to be confirmed) and will be eligible to win the £500 cash prize for the 'Best Act' (Finalists)
- The Finalists will be
further judged by a jury, selected by Us, at
the Final with a prize
of £500 being awarded to the Competition Entry which is deemed the
winner by the majority of the jury.
- Prize winners will be announced
at the Final.
- In all matters, the decision
of the jury and Us shall be final and no correspondence
or discussion shall be entered into.
- Prizes are awarded at Our
discretion and no prizes will be awarded as a result of improper actions
by or on behalf of any entrant including but without limitation breach
of the Terms of Use that govern the use of Our Site. We and/or the Competition judges (acting reasonably)
reserve the right not to select a winner, and/or to remove or amend
selection criteria and/or the structure and operation of the Competition
if Entries are not of the requisite standard.
- Qualifying
Entrants
- Employees of Avin A Larf
Limited or any other company involved in the Competition or, if relevant,
production of a television programme to which a Competition relates,
or any advertising agency or web company connected with Us or any such
person’s subsidiary or associated companies, agents or members of
their families or households, are not eligible to enter the Competition.
- By uploading a video and
thus entering the Competition, you hereby warrant that all information
submitted by you is true, current and complete. We reserve the right
to verify the eligibility of all entrants.
- The Competition is open to
all age groups. We assume that by using Our Site and entering the Competition
(and you warrant that) you are aged 18 or over or, if you are under
18, that your parents have consented to you entering into the Competition
and these Rules.
- We reserve the right to disqualify
any entrant if We have reasonable grounds to believe the entrant has
breached any of the Rules.
- In the event that any entrant
is disqualified from the Competition, We may in Our sole discretion
decide whether a replacement should be selected. In this event, any
further entrant will be selected on the same criteria as the original
entrant and will be subject to these Rules.
- Competition
Entries
- You may only submit one video to the Awards section for entering the competition, .
- Competition Entries must
be uploaded onto Our Site by the closing date of midnight on 12th
December 2009. Failure to do so will disqualify the entry.
- All entrants must be registered
users of Our Site. There is no charge to register for use of Our Site.
- There is no charge to enter
the Competition.
- We cannot accept responsibility
for any error, omission, interruption, deletion, defect, delay in operation
or transmission, communications line failure, theft, destruction, alteration
of or unauthorised access to Competition Entries, or Competition Entries
that may be lost, damaged or delayed as a result of server functions,
technical issues, virus, bugs or other causes outside of Our control.
- Intellectual Property Rights & Use of Entries
- We do not, unless we agree
this with you, claim any rights of ownership in your Competition Entry.
- In consideration for Us agreeing
to consider entrants to the Competition, each entrant hereby agrees
that We may make any and all Competition Entries available on Our Site
and any other media, whether now known or invented in the future, which
may include other internet sites, mobile, television and/or radio and
that Entries may be made available with advertising and/or sponsorship.
You now grant Us (and third parties authorised by Us) a non-exclusive,
worldwide, transferable, irrevocable licence (for the full period of
any rights in the Competition Entry) to use, display, publish, transmit,
copy, make derivative works or podcasts from, edit, alter, store, re-format,
sell and sub-licence the Competition Entry for such purposes.
- For the avoidance of doubt,
the licence in clause 5.2 is in addition to any other licence granted
by you under the Terms of Use of Our Site.
- Your Competition Entry, and
any information submitted by you must be personal to and relate specifically
to you. You hereby warrant that your Competition Entry and all information
which you submit and/or distribute will not infringe the intellectual
property, privacy or any other rights of any third party, and will not
contain anything which is libellous, defamatory, obscene, indecent,
harassing or threatening. If relevant, We reserve the right, but not
the obligation, to screen, filter and/or monitor information provided
by you and to edit, refuse to distribute or remove the same.
- Liability
- We cannot accept
any responsibility for any damage, loss, injury or disappointment suffered
by any entrant entering the Competition or as a result of accepting
any prize. We are not responsible for any problems or technical malfunction
of any computer on-line systems, servers, or providers, computer equipment
or software, failure of any email or entry to be received on account
of technical problems or traffic congestion on the Internet, or at any
web site, or any combination of these, including any injury or damage
to entrant’s or any other person’s computer related to or resulting
from participation or downloading any materials in the Competition.
Nothing shall exclude Our liability for death or personal injury as
a result of its negligence.
- Data Protection and Publicity
- Finalists and winners may
be requested to take part in promotional activity and We reserve the
right to use the names of Finalists and winners, their photographs and
audio and/or visual recordings of them in any publicity.
- Any personal data relating
to entrants will be used solely in accordance with current UK data protection
legislation and will not be disclosed to a third party without the individual’s
prior consent. Please see Our Privacy Policy for further details. Data relating to entrants will be retained
by Us for a reasonable period after the Competition closes to assist
Us to operate competitions in a consistent manner and to deal with any
queries on the Competition.
- Jurisdiction
- The Competition
and Rules will be governed by English law and any disputes will be subject
to the exclusive jurisdiction of the courts of England and Wales. We
make no representation that materials on Our Site relating to this Competition
are appropriate or available for use at other locations and access to
them from territories where their contents are illegal is strictly prohibited.
If you access Our Site outside of the United Kingdom or Republic of
Ireland, you are responsible for compliance with all local laws.
